T3 Youth Development — Minor Participant Waiver

⚠ Notice to Parent or Legal Guardian — Read Carefully

You are agreeing to let your minor child engage in potentially dangerous activities. Even where T3 Youth Development exercises reasonable care, there is a chance your child may be seriously injured or killed because there are certain dangers inherent in these activities which cannot be avoided or eliminated.

By submitting this form, you are giving up your child's right and your own right to recover from T3 Youth Development in a lawsuit for any personal injury, including death, or property damage resulting from risks that are a natural part of the activity.

This waiver does not apply to gross negligence or intentional misconduct. You have the right to refuse to submit this form.

1 — Voluntary Participation & Scope

I am the parent or legal guardian of the minor child identified below. I voluntarily permit my child to participate in all programs organized by T3 Youth Development, including but not limited to: running, fitness training, educational sessions, mentoring, community service, and recreational activities (collectively, "Activities").

"Released Parties" means T3 Youth Development, its directors, officers, employees, volunteers, coaches, mentors, sponsors, partners, and affiliates.

2 — Assumption of Inherent Risks

The Activities involve inherent risks that cannot be fully eliminated, including:

Falls, trips, slips, and collisions with objects or other participants
Dehydration, heat exhaustion, heat stroke, and effects of extreme heat or humidity
Traffic, vehicular hazards, and uneven or unpaved running surfaces
Exposure to wildlife, insects, and environmental hazards
Exposure to infectious diseases, viruses, and communicable illnesses
Equipment malfunction or failure
Risks associated with adult mentoring, group transit, and community service environments

I acknowledge that these risks may cause serious bodily injury, illness, permanent disability, emotional distress, property damage, or death.

I have read Sections 1 and 2. I knowingly and voluntarily assume all inherent risks described above on behalf of my child.

3 — Fitness & Medical Disclosure

I certify that my child is physically fit and mentally capable of participating in the Activities. I understand that T3 Youth Development relies on the accuracy of the information I provide. It is my sole responsibility to monitor my child's physical condition and to update T3 Youth Development if any relevant health information changes.

4 — Emergency Medical Authorization

I acknowledge that T3 Youth Development does not provide on-site medical staff. In the event of a medical emergency, I authorize T3 Youth Development to: (a) contact emergency medical services immediately; (b) consent to necessary emergency treatment, hospitalization, or surgery if I cannot be reached; and (c) release relevant medical information to treating providers. I assume full financial responsibility for all medical costs incurred.

5 — Release of Liability — Ordinary Negligence Only

IMPORTANT: This release applies ONLY to claims arising from ordinary negligence. It does NOT release any claim for gross negligence, reckless conduct, or intentional misconduct.

To the fullest extent permitted by Florida law, I hereby release, waive, discharge, and covenant not to sue the Released Parties from liability arising from ordinary negligence related to my child's participation, consistent with Florida Statute § 744.301.

6 — Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any third-party claims arising from: (a) my child's participation; (b) my breach of this Agreement; or (c) any inaccurate information I have provided.

7 — Photo & Media Release

I grant T3 Youth Development the right to photograph or video record my child during Activities for promotional, educational, and fundraising purposes, limited to T3 Youth Development and direct partners. My child's likeness will not be sold to unaffiliated third-party advertisers. I may withdraw this release prospectively at any time in writing.

I agree — T3 Youth Development may use photos/video of my child for promotional and educational purposes.

I opt out — My child's image may not be used for any promotional purposes.

8–10 — Dispute Resolution, Governing Law & Entire Agreement

Before litigation, the parties agree to 30 days of good-faith negotiation, then non-binding mediation in Brevard County, Florida. This Agreement is governed by Florida law; venue is exclusively in Brevard County. If any provision is held invalid, the remaining provisions continue in full force. This Agreement is the entire agreement between the parties.

Acknowledgments

I have read Sections 3 and 4. I certify my child is fit to participate and I authorize emergency medical treatment if I cannot be reached.

I have read Section 5. I understand this release covers only ordinary negligence and does NOT cover gross negligence or intentional misconduct.

I have read Sections 6–10 and agree to the indemnification, media release, dispute resolution, and governing law provisions.

11 — Acknowledgment of Understanding

By submitting this form, I certify that: (1) I am the natural guardian or legal guardian of the minor child named above; (2) I have read this entire document and fully understand its contents; (3) I understand that I am giving up substantial legal rights for myself and, to the extent permitted by Florida law, for my child; (4) I have had the opportunity to seek legal counsel; and (5) I sign freely and voluntarily.
